LOS ANGELES, CALIFORNIA: A judge has ordered Sam Asghari, the ex-husband of pop star Britney Spears, to either "move forward" with their divorce case or file for a "dismissal."

The US Sun obtained court documents that show a notice sent by Shelley Kaufman, Supervising Judge for the Family Law Division to Sam’s lawyer Neal Raymond Hersh on Friday, October 27, for Los Angeles Superior Court.

Report states that Britney Spears has not received divorce papers yet

The notice states, “If you do not want to proceed with this case, you must file a Request for Dismissal with the Court.”

This, according to the report, implies that Britney has not yet been notified of the divorce.

The notice also asks Sam’s counsel to take the necessary steps for the case to move forward, such as delivering the summons and petition to Britney and filing a proof of service with the court.

Sam Asghari faces court fine and dismissal if he fails to act on divorce

Sam’s attorney must also participate in a status conference on November 15 at 8.30 am.

The notice warns, “If you file a Proof of Service or Request for Dismissal before the hearing date listed above, you do not need to participate in this Status Conference.”

However, if Sam fails to do so and does not attend the status conference, he may have to pay a court fine and the case will be dismissed, the documents state, according to the report.

Sam Asghari seeks spousal support and challenges prenup with Britney Spears

Sam, 29, filed for divorce from Britney, 41, on August 17, after 14 months of marriage. He cited “irreconcilable differences” as the reason for ending the relationship.

Reports claim that Britney cheated on Sam, but she has not confirmed or denied the allegations. Sam, too, has not

commented on the rumors but has praised Spears for writing her memoir.

TMZ reported that Sam is seeking spousal support from Britney and asking her to cover his legal fees.

His lawyer has also hinted that Sam may challenge their current prenup which keeps Britney’s assets as separate property.

Sam’s initial divorce filing states that he has yet to determine the full nature and extent of their assets and debts.
