Kevin Costner stated that Christine Baumgartner refused to vacate his Santa Barbara mansion home and was accused of violating the prenup

LOS ANGELES, CALIFORNIA: Kevin Costner's nasty divorce battle continues as the actor has demanded his estranged wife Christine Baumgartner to pay him $99,225 to cover his legal fees after she fought their prenuptial agreement.

The 'Yellowstone' actor requested the six-figure sum as pointed to their prenup signed in 2004 which contained a provision that read, "should either party retain counsel to enforce or prevent a breach of any provision of this Agreement, then if such matter is resolved by judicial intervention, the prevailing party, whether at trial or on appeal, shall be entitled, in addition to such other relief as may be granted, to be reimbursed by the non-prevailing party for all costs and expenses incurred thereby, including but not limited to reasonable attorney's fees," according to Radar Online.

Baumgartner previously violated the prenup

Costner stated that he had to fight his estranged wife to enforce his right under the agreement to "sole possession and control of his separate property residence." He stated that Baumgartner refused to vacate his Santa Barbara mansion home and was accused of violating the prenup as she is required to leave his residence within 30 days of a divorce filing. The handbag designer filed for divorce from Costner on May 1.

The actor and his attorney Laura Wasser have sought the court to issue an order prohibiting her from continuing to reside in his mansion, according to court documents. Despite her fighting to stay in the home until August, the judge ordered her to leave the mansion this month.

Costner paid Baumgartner a $1 million lump sum after divorce

The 'Letting Go' actor's new motion is filed as he claims his right to get his legal fees reimbursed. Costner claimed he paid $60k to his attorney Wasser and another $30k to the Misho Law Group. He also reminded that he has made a lump sum payment of $1 million to his ex-wife after the divorce filing and suggested she could use the amount to pay the fees for the attorney.

However, as taking the money would prevent Baumgartner from fighting the prenup agreement, she has refused to receive the funds. The former couple who share three children, Cayden Wyatt Costner, 16, Hayes Logan Costner, 14, and Grace Avery Costner, 13 had a long fight over child support that came to an end on Tuesday. Costner who previously opposed Baumgartner's demand of $248k per month is now required to pay $129,755 per month for child support.
